a) Elite Matrimony (EM) intends to facilitate lawful marriages between persons who are capable of entering into marriage as per the law applicable to them. Membership and rights of admission is reserved solely for :

Indian Nationals & Citizens.

Persons of Indian Origin (PIO).

Non Resident Indians (NRI).

Persons of Indian Descent or Indian Heritage

Persons who intend to marry persons of Indian Origin.

b) Further in capacity as member or guardian of member or representative of the member you confirm that you are / you are registering for a person who is :

18 years or above (if you are a woman) or 21 years or above (if you are a man);

Legally competent to marry as per the law applicable to you and

Not prohibited or prevented by any applicable law for the time being in force from entering into a valid marriage.

a) We expect that you would complete the registration process with fairness and honesty while furnishing your personal informations. You would appreciate that efficient and effective match making depend upon yourself furnishing true, accurate, current and complete information. You further undertake that you alone shall be responsible or liable for any information provided in this application form. In order to serve you better if EM requires additional details you agree to provide it.

b) If at any point of time EM comes to know or has reasons to believe that any information provided by you for registration or otherwise is found to be untrue, inaccurate, or incomplete then EM shall have full right to suspend or terminate your membership and forfeit the amount paid by you towards membership fee and refuse to service you thereafter

Tenure of the service shall be 3, 6 & 9 months depending upon the package offered by EM or for any tenure which may be introduced from time to time.

a) Payment made by cash / cheque / Net Banking / Debit / Credit Card would be in accordance with the prevailing RBI guidelines. Activation of service shall be subject to realization of the said instrument normally within 3 days. In case of dishonor of Cheque; you shall be liable to pay Rs.100/- (Rupees One Hundred Only) as bank charges. Further service to your account will be deactivated / suspended until you settle the value of the Cheque and bank charges in cash.

b) EM uses third party payment gateways. In case of gateway failure the same would be communicated to the member. EM shall not be responsible for Extra currency/conversion charges/deductions/error issues from payment gateway. In the case of failed online transactions, which result in no services, EM offers no guarantees whatsoever for the accuracy or timeliness of the refunds reaching the Customers card/bank accounts

c) Member who has opted for Platinum Service, Success fee shall be paid on finalization of the Marriage.

a) Upon enrollment into the services a Relationship Manager shall be assigned to you who will help you with the process of match making.

b) EM will endeavor to provide at least one profile per week as per your partner preference subject to availability of profile in the data base. The service will be carried out only during normal working hours of EM ie., 09:30 am to 06:00 pm Monday to Saturday excluding Sunday and public Holidays. RM entrusted with your profile shall contact you at least 2 times in a week to update you on profile management.

c) EM shall shortlist and initiate contact with prospects if age difference is as follows :

For male members - Prospects age difference is less than 10 years.

For Female members - Prospects is of same age or above.

d) Similarly in case Marital Status of the member is Divorced / Widowed / Separated then EM shall shortlist and initiate contact with prospects who are Divorced / Widowed / Separated only. EM will not get in touch with prospects with different marital status.

e) Suggestions made by our staff are based on the data provided by the members. Member is expected to exercise due care and caution while proceeding with finalization of marriage with the shortlisted profile.

f) The profiles shared to the members are from the data available from the consortium of portals from Matrimony.com. Members profile will be retained in the EM database until the member communicates finalization of his / her marriage or intention not to retain in the database expressly in writing.

g) At EM we value your privacy. We consider your contact information as confidential hence will be shared to prospect only after obtaining your consent.

h) EM's responsibility is restricted only to offer matrimonial profiles to its members based on their preference. EM cannot guarantee or assume responsibility for any specific results from the use of the website and / or the service.

i) Shortlisted profile information link shared with you will be active only for 5 days from the shared date.

a) To protect the broader interest of the member and increase the efficiency of the service, you shall authorize one person to be your authorized representative. The Authorized representative shall be Member or his / her Parent / sibling only

b) All Members should disclose the details of the single point contact person (Authorized Representative) namely name, email id and phone no. in the membership form.

c) All communication between EM and yourself shall either be routed to you or through your authorized representative as the case may be.

d) Acceptance by you or your authorized representative shall be deemed final.

e) Any additional information / data required by EM for profile management shall be provided by the Member / Authorized representative as and when sought. Time and opportunity loss associated with the delay in response shall be borne by the member themselves and EM shall not be responsible for the same.

f) Member can expect EM to short list and share profiles of those prospects whose partner preference and expectations are matching with the member's profile. In case member's / prospect partner preference has undergone change then profile may be shared to either member / prospect after such change though not shared initially.

g) Members are requested to exercise due care and caution while shortlisting the prospect and satisfy themselves before making a choice of your match through adequate efforts, initiatives and due diligence. EM will not be liable for short coming due to any misrepresentations made by any of its members.

h) Members are expected to verify the credentials of the prospect such as family status, educational qualifications, financial status, occupation, character, etc.

i) Members are expected to provide latest photograph which should not be more than 3 months old. Providing old photographs, inaccurate / false information of their educational qualification and income details shall be treated as violation of terms and conditions.

j) Members are expected to disclose their health records during profile enrollment which includes any pre-existing illness, physical disability etc. Non- disclosure at the time of enrollment shall be treated as violation of the terms and conditions.

k) Members are expected to refrain from :

Entering into financial transactions with shortlisted prospects prior to solemnization of marriage.

Dealing with shortlisted prospects before carrying out due verifications of the prospect.

Entering into personal relationship with prospect before marriage.

Sharing of confidential and personal data with each other but not limited to sharing of bank details, etc.

Not violates any law for the time being in force;

l) To serve us better EM may place Matrimonial Classifieds derived from our profile in newspapers, television or any other media at the discretion of EM masking the name and address of the member.

m) Members are expected to be cautious of prospects who call from multiple numbers and don’t involve family and friends in match making. Beware of suspended profiles status before you finalize an alliance with the prospect. Member cannot use the profile shared to them for the benefit of any third person(s) or for gaining any commercial benefits.

n) Membership is restricted strictly to individuals only. Organizations, companies, businesses and/or individuals carrying on similar or competitive business cannot become Members of EM and nor use the EM Service for any commercial purpose.

o) You shall not assign or transfer your account to any other person or entity.

p) You cannot put the service on hold for temporarily for whatsoever reasons. Based on the tenure of service and date of payment taken the expiry of service will automatically happen.

q) Members are expected to visit URL http://www.bharatmatrimony.com/safe-matrimony/index.php for understanding the safety measures on partner search and awareness towards online safety.

a) Member and / or authorized representative hereby consent from receiving communication including promotional communications through any medium of communications such as Emails and /or SMS/Calls

b) EM may contact the customer through any of the above media to share the profile of the prospect by way of internal messages / links or to sell different services to the member customers. Authorized Representative confirm that the mobile number submitted is not registered with the Do Not Disturb / National Customer Preference Register and they shall not initiate any complaint. Member / Authorized representative further confirms that even if Member / Authorized representative is registered with the telecom service provider under the category Do Not Disturb / National Customer Preference Register the calls from EM shall not be treated as promotional calls.

a) EM will maintain confidentiality of all personal information [other than that meant for sharing with the prospect] furnished by members and shall take all possible and /or bonafide steps for maintaining the confidentiality. However, EM may divulge such information if required by law.

b) Any feedback you provide to EM shall be deemed to be non-confidential. EM shall be free to use such information on an unrestricted basis. Further, by submitting the feedback, you represent and warrant that (i) your feedback does not contain confidential or proprietary information of yourself or third parties; (ii) EM is not under any obligation of confidentiality, express or implied, with respect to the feedback; (iii) you are not entitled to any compensation or reimbursement of any kind from EM for the feedback under any circumstances.

a) You would appreciate that EM endeavor to search the prospect on the basis of the partner preference set by both the members and share the contact details with each other.

b) EM is not a broker or the agent of any member and does not partake in the exchange of any kind of discussion between the members or the results thereof. Member’s are solely responsible for your communications with other Member.

c) EM shall not be held responsible for any interactions/ passing of information(s) etc. between any members via e-mail, chat or any other mediation with another member. And also expressly disclaims any responsibility or liability for any transactions or interactions between the members inter-se.

d) EM has no obligation, to monitor any such disputes arising between the users/members and EM shall not be party to any such dispute/litigation etc.

a) You acknowledge that you are responsible for the content and information including the profile details , photograph and other content provided at the time of the creation of the profile and also all the post and communication with other members. You hereby represent and warrant that you own all rights, title and interest in your content or have the necessary licenses, rights, consents, and permissions to provide the said content. However, by submitting the Content to EM, you hereby grant the Company a worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of, display, publish, communicate to the public and the Company's business and services, including without limitation for promoting, communicating to the public and redistributing part or all of the Content (and derivative works thereof) in any media formats and through any media channels.

b) You hereby also grant the Company and its authorised third parties a non-exclusive license to access your Content and to use, reproduce, distribute, prepare derivative works of, display, communicate to the public and perform such Content.

c) While the Company does not accept any obligation to monitor the Content, if the Content is found not to be in compliance with these Terms, the Company may delete the Content and / or terminate your registration without a refund of any subscription paid by you.

d) EM reserves the right to suspend/delete the profile of the users who appropriate the name, likeness, email address, contact no or other personally identifiable information of another individual.

e) Elite Matrimony is a brand owned by Matrimony.com Private Limited. Matrimony.com Private Limited owns, retains and has complete rights in Elite Matrimony and their Service.

f) Matrimony.com Private Limited reserves the right to proceed/initiate appropriate steps under the prevailing law against infringement by violators of the said proprietary rights for illegal copying, modifying, publishing, transmitting, distributing, performing, displaying, or selling of any such proprietary information.

Before the expiry of the tenure of the scheme, you have the option to renew the subscription by paying the renewal fee for the scheme opted for.

You will appreciate that to service your profile lot of time and energy of the RM is spend in assisting you in setting the partner preference, searching the profiles as per the partner preference, etc. As such payments made to us by way of registration / membership / renewal fee is are treated as non-refundable. Payment once made cannot be assigned to any person/party or adjusted towards any other product or scheme provided by the Company.

a) Third party websites to which links are given on this Website are not governed by these Terms and are governed by their own terms and conditions for use and privacy policy. The Company does not in any manner whatsoever authenticate, endorse, verify or certify these third party websites or any contents therein. Please note that a User shall click on links to third party websites at his / her sole risk and responsibility.

b) EM reserves the right to add/delete/alter/modify/suspend any or all the services at any time as it may deem fit.

a) EM likes to inform you that the exchange of matrimonial profile(s) through or by EM should not in any way be construed as a matrimonial offer and/or recommendation and / or advice given to the member from or by EM.

b) Matrimony.com Private Limited / Elite Matrimony or its Office bearers shall under no circumstances be liable or responsible to the member or his/her authorized Representative or Guardian or any third party for any indirect, special, exemplary, incidental, or consequential damages of any character including, without limitation, damages resulting from the use of our services.

c) Notwithstanding anything to the contrary contained herein, EM's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to EM, for the Service during the term of membership.

a) The Website shall be deemed to be used by you when it is loaded and/or continues to be loaded in temporary or permanent memory of your mobile phone, computer or any other device or in the internet browser thereof.

b) EM is an intermediary as defined under sub-clause (w) of Section 2 of the Information Technology Act, 2000.

c) EM reserves the absolute right to modify or amend or delete, in any manner as it deems fit, any content of any matrimonial listing placed on EM in order to ensure compliance with the rules of such placement, prima facie accuracy and the prevailing laws in force for the time being, especially those relating to prohibition of any indecent, unlawful or obscene content. EM also reserves the right to delete / suspend the profile which might be offensive, illegal or that might violate the rights, harm or threaten the safety of EM and/or its Members.

d) After the expiry of the Elite Matrimony service, the profiles shall remain in the database of the company itself until the member intimate the finalization of marriage.

a) Your access to and use of the Services or any Content is at your own risk. YOU UNDERSTAND AND AGREE THAT THE SERVICES ARE PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS. WITHOUT LIMITING THE FOREGOING, TO THE FULL EXTENT PERMITTED BY LAW, EM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. To the full extent permissible by applicable law, BM disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. EM does not warrant that this site, its servers, or e-mail sent from EM are free of viruses or other harmful components. EM will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

b) Notwithstanding anything contrary contained anywhere, under no circumstances, EM shall be held responsible or liable whatsoever ort howsoever, arising out of, relating to or connected with:

any act or omission not done by EM;

any untrue or incorrect information submitted by you or on your behalf;

any decision taken by you or on your behalf or any consequences thereof, based on any information provided by any other user;

any unauthorized or illegal act done by any third party relating to or connected with any information submitted by you or on your behalf;

any cybercrime attempted or committed by anyone and

any incident of force-majeure or 'act of god'.

By using our services you agree to defend, indemnify, and hold harmless EM, its subsidiaries, affiliates, Directors, officers, agents, and other partners and employees, fully indemnified and harmless from any loss, damage, liability, claim, or demand, including reasonable attorney's fees, made by any person through improper use of the service provided by EM. This defence and indemnification obligation will survive in perpetuity.

EM reserves the right to forthwith terminate your membership, block/delete your profile and forfeit entire amount paid as membership fee; if at any time EM, in its sole discretion, is of the opinion or has any reason to believe that, you have violated these Terms of Use or provided false information to EM or you are not eligible to use the service or that you have made any misrepresentation about your eligibility or details furnished by you are fake / false / bogus information is provided by you.

a) At the option either of the parties, the membership may be terminated without assigning any reasons by serving 7 days written notice on the other all amount paid till date by you shall be forfeited.

b) Upon termination / suspension of your membership, your right to use or access the website will cease immediately. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, disclaimers, and limitations of liability. Termination of your access to and use of the Services shall not relieve you of any obligations arising or accruing prior to such termination.

a) The registration of membership and all services are deemed to have been entered into within the territorial Jurisdiction of Chennai, India.

b) The Members unconditionally agree that all such disputes and / or differences if any shall be governed by the Laws of India and submitting to the exclusive Jurisdiction of appropriate court of law in Chennai, Tamil Nadu, India.

c) You hereby, unconditionally and irrevocably confirm that you have read terms and conditions and agree to abide by them.
